2.1.1 FAMILY If you have a relationship or family ties with an Australian citizen or PR, you may qualify for PR but this area requires sponsorship and has stringent requirements, which must be met before you are eligible. Holders of temporary partner visas may apply for PR once the provisional 2-year qualification period (of being together) is met. If you do not qualify, you may still be eligible for a temporary visa. Some general points in regard to family migration: - De Facto relationships (at least one year of living together) are recognised - Homosexual relationships may be recognised under the interdepenency category - Relatives may qualify if they have been dependent on an Australian citizen or PR for financial support over an extended period - Orphans with no living relatives overseas may be sponsored by an Australian citizen or PR - Temporary visas may be issued to those with prospective and genuine marriage intentions - Assurance of support is mandatory for some visa classes Family may consist of: - Spouse - Prospective Marriage - Child - Adoption - Parent - Orphan Relative - Special need Relative - Aged Dependent Relative - Remaining relative - Other family members Other Family members are concessional family members. This requires a relative to be a sponsor. Concessional Family members are: - Non Dependent children - Parent of working age - Brother / Sister - Niece or Nephew Interdependency Migration The applicant needs an Australian citizen, PR or an eligible New Zealand Citizen as a aponsor and must have a continuing and genuine relationship to the sponsor, with a commitment to live together.
